HC dismisses TANGEDCO's review pleas

The Madras High Court has declined to entertain the review pleas filed by Tamil Nadu Generation and Distribution Corporation LTD on absorbing over 900 contract labourers as per a labour court order of 2007.
The matter relates to several awards (orders) that were passed by the Inspector of Labour, Cuddalore District on the petitions filed by the temporary workers of TANGEDCO claiming permanent status to them.
Since the awards were not implemented, some workers filed petitions seeking a direction to the TANGEDCO to implement the order passed by the Labour Inspector and absorb them as permanent employees.
The petitions were disposed of by a single judge on September 16, 2011 directing TANGEDCO to comply with the orders passed by the Inspector, as they were not challenged.

TANGEDCO filed appeals against the order of the single judge which were dismissed.
It then filed a special leave petition before Supreme Court alleging forgery on the part of the orders passed by various labour inspectors which was dismissed by the apex court giving liberty to approach the high court by filing review applications.

Dismissing the applications, a division bench, comprising justices M Sathyanarayanan and T S Sivagnanam, said in the review pleas, "There is no specific stand stating that the awards are forged, rather the stand initially taken was that the awards were based on forged documents."
"However, this could not be established by the review applicant before this court by any material evidence."

"In the absence of error apparent and upon failure of the applicant to prove or establish a fraud or fabrication, the review applications fail and they are dismissed.
