HC finds no material of criminal intimidation against Govinda

The Bombay High Court today observed that there is no material of criminal intimidation in the complaint filed against actor Govinda by one Santosh Rai, who had accused the actor of slapping him.
Justice M L Tahaliyani was hearing a petition filed by Govinda seeking to quash the proceedings initiated against him by the Borivili magistrate court on the assault and criminal intimidation complaint filed by Rai.
Rai had on February 5, 2009 filed a complaint in the magistrate court alleging that the actor had on January 16, 2008 slapped him and threatened him.
However, after perusing the complaint, Justice Tahaliyani today observed that the complainant has not mentioned anything about criminal intimidation.
"In the complaint where is the allegation of criminal intimidation? The court is not going to imagine that the petitioner (Govinda) had threatened you (Rai). There is no material of criminal intimidation in the complaint. How are you (Rai) going to prove criminal intimidation," Justice Tahaliyani said.
The court also queried as to why the complaint was filed after a year to which Rai's advocate Raja Roy could not give a satisfactory reply.
The court then adjourned the matter for five weeks and directed Roy to prepare his case properly.
Under section 352 (using criminal force or assault) Govinda faces three month imprisonment and under section 506 (criminal intimidation) the actor faces a two year jail term if found guilty.
