HC moved over 4% quota for disabled to PG Assistant post

A PIL has been filed in the Madras High Court seeking four percent reservation for the disabled, in the direct recruitment of PG assistant teachers in school education and other departments for 2016-17.
A division bench of Justices MM Sundresh and R Mahadevan ordered notice to Tamil Nadu government and Teachers Recruitment Board on a PIL filed by S Nambirajan, State Secretary of Tamil Nadu Association for the Rights of All types of differently-abled and caregivers.
It then posted the matter to June 2.
The petitioner sought to quash a notification issued by TRB for the direct recruitment of Post Graduate Assistant and Physical Education Directors (Grade-I) in School Education and other departments for the year 2016-17.
He also prayed for a Court direction to the board to issue a fresh notification by providing 4 percent reservation and also remove the restriction imposed on the persons with disabilities under certain category.
Section 34 of the Rights of Persons with Disabilities Act, 2016 provides for reservation of 4 percent to the persons with disabilities but the notification provides only 3 percent reservation, which was against the Act, the petitioner submitted.
Clause 3(b)(iii) of the notification imposes restriction in such a way that the differently-abled people within the category of OA (one arm), OL (one leg) and BL (both legs) suffering with 40-70 percent were alone eligible to apply, which was against an order issued by Department for Welfare of Differently-Abled Persons, which does not impose any restriction for the post of Post Graduate teachers, he said.
Out of the total number of vacancies of 1663 posts, only 18 posts have been shown in the roster point to be filled up by the persons with disabilities which does not even cater 3 percent reservation provided by the Act when 67 posts have to be reserved in accordance with the Act, the petitioner added.
