The bench also sought to declare the results of admission for this year's Post Graduate Medical courses including MD, MS and diploma courses, as ultra vires.
Justice Nagamuthu, hearing a petition filed by one Dr A Jegan of Tirunelveli district, also ordered to serve notice to the National Counselling committee and director of Medical Education.
The petitioner submitted that results published by respondents for the National Eligibility-Cum-Entrance Test (Post Graduate) showed that 27 per cent reservation had not been provided to OBC candidates.
Contending that the counselling committee had failed to implement the reservation system, he pointed out the 27 per cent reservation had been upheld by the Supreme Court.
Besides, 50 per cent of the PG diploma courses should be reserved for Medical officers in government service. This provision had also not been implemented.
Another provision in determining merit, namely 10 per cent mark for each year of service in remote rural areas had also not been implemented, the petitioner said, adding he had got 38.76 per cent, while actually he should have been given 46.51 per cent taking his village service into consideration.
Jegan also sought an interim direction to revise the rank list/results of the NEET (Post graduate) 2013 results/rank list by providing 27 per cent reservation for OBC category students and allot respective seats by conducting fresh counselling.
