The High Court said it cannot go into the allegations of misuse of power and human rights violations raised in the PIL against Kumar as the petitioner has directly approached it without moving the "competent authority".
"An order cannot be passed as there is no representation to the competent authority before approaching this court. He can send his representation to the competent authority.
The bench said the petitioner M S Devasayam, a Chennai- based retired IAS officer, can make a representation to the Union Home Ministry within a week.
Kumar, 1976 batch IPS officer, was appointed as the Delhi Police Commissioner on June 28, 2012.
Devasayam sought quashing of Kumar's appointment alleging that he has been facing several charges of misuse of power and human rights violations which had come in way of his selection as CBI Director.
