HC reserves orders on Thettayil's petition

Kerala High Court today reserved orders on the petition by former LDF Minister Jose Thettayil challenging the FIR registered against him for alleged rape.
Justice P Bhavadasan reserved the orders after hearing the petitioner, the state government and the complainant.
The state and the complainant stoutly opposed the prayer by the petitioner.
Meanwhile, the petitioner maintained the stand that no offence has been made out against him in the complaint.
The court had twice stayed all further proceedings against Thettayil, former Transport minister and JD-S MLA from Angamally, who is the first accused in the case. His son, Adarsh, is the second accused.
Aluva Police had recently registered a case against him and his son based on the complaint of a woman that she had been sexually harassed by the duo.
Thettayil contended that he had not committed any offence punishable under IPC section 376 (rape) and the allegations of the woman were absolutely false.
He alleged that it was reliably understood that the woman had been instigated by some prominent leaders of the ruling political front to fabricate the case against him and his son with the ulterior motive to tide over the "political crisis prevailing in the state."
Meanwhile, the Aluva Judicial First class magistrate court today dismissed a petition seeking to register a case against the complainant for violating the provisions of the IT Act.
The petitioner had contended that the complainant woman had allegedly recorded a CD showing her along with Thettayil which was telecast by various television channels.
