A division bench of Chief Justice Mohit Shah and Justice A K Menon took suo moto (on its own) cognizance of the matter after a letter written to it by activist Purnima Upadhyay highlighting the condition of G N Saibaba.
Saibaba was arrested last year by Maharashtra police for his alleged links with Maoists. He is lodged in Nagpur prison.
The High Court has directed the authorities to file their affidavits giving details of Saibaba's health condition and the status of the investigation against him and if a charge sheet against him has been filed or not.
The court will hear the petition on June 17.
