For the first time in its history, the Bombay High Court is introducing an e-court which would entertain petitions on e-mails and totally eliminate paper work, official sources said today.
Being set up as a pilot project, the e-court, presided by Justice Nitin Jamdar, would be inaugurated on August 15 and take up company matters to start with.
Later, such court would also entertain other petitions besides hearing company matters, the sources said.
All matters on the Original Side pertaining to Company Court arising out of proceedings under provision of section 391 of Companies Act, 1956, will be accepted through e-filing from August 5, according to Mangesh Patil, Registrar-Judicial.
The petitioners have been directed to lodge soft copies of such matters/ proceedings with the Original Side Registry either by pen-drive or a compact disk.
The date of presentation of such pen-drive or compact disk shall be deemed to be the date of institution/ presentation/lodging for all purposes including for the purpose of limitation.
However, as a precautionary measure, initially, the petitioners have also been asked to lodge a hard copy of the aforesaid proceedings along with soft copy. Later, this would be done away with.
In the e-court, the judge would go through the petition on the screen by switching on the computer. Similarly, the Shristidar would also refer to the petition on the computer.
The lawyers would go through the contents of the petition in their laptops and submit arguments on that basis.
