Helmet wearing: HC directs advocates to file affidavit

The Madras High Court today directed advocates who sought exception on the order of making wearing of helmet a compulsory to two-wheel riders including women, children and people who suffer from ill health to file an affidavit detailing the causes.
The objections were raised by advocates including R C Paul Kanagaraj, President of Madras High Court Advocates Association stating that the Government in 2007 after hearing objections withdrawn it to the extent of exempting the pillion riders and some other religious people from wearing it.
But the latest order said everybody is compelled to wear helmt, Kanagaraj stated.
He also sought to direct the court to appoint a retired Judge of Madras High Court to get the opinion from public on wearing of helmet.
Justice N Kirubakaran said at initial stages there will be always some problem in the implementation of any new law and gradually it will disappear.
Kanagaraj submitted that the bad condition of roads and that of street lights are also the cause for accidents and not only the helmets.
Judge said there was no question of staying that and directed all the advocates to file affidavit in this regard.
The High Court had last month held that two-wheeler riders in Tamil Nadu must wear helmets from July 1 or risk impounding of their driving license.
