The 27-year-old actress filed divorce papers shortly after rumours popped up about Comrie, 34, having a wild night out with friends at a restaurant in Beverly Hills, California, reported TMZ.
The pair announced their separation in January 2014, but Duff has apparently listed their separation date as January 2013.
The were reports that Duff was seeking primary custody of their nearly three-year-old son, Luca.
The actress previously insisted their split was amicable and they have frequently been spotted together over the past year.
The former couple got married in August 2010.
