HMK leader murder; trial court order convicting 2 set aside

The Madras High Court today set aside a trial court's judgement convicting two accused Anees alias Mohammed Anees and Ibram Shah in a case relating to murder of Hindu Makkal Katchi leader Kalidoss here on June 21, 2005.
Justices P R Sivakumar and V S Ravi allowed their appeal on the ground that the entire process of summoning Kalidoss's son to the police station, being told that the two were the accused, asked to identify them in an identification parade, which he did, and other witnesses admitting they did so only after seeing photos shown by police, was against Evidence Act.
The judges citied this reason and set aside the trial court judgement.
The prosecution case was that that Kalidoss, who reportedly gave speeches against the minority community, was also the main witness in the murder of HMK leader Rajagopalan.
Seven accused members had developed enmity against Kalidoss and conspired to kill him on June 21, 2005, they said.
Kalidoss was killed in the city that day when he was on way to meet a friend.
