A special MCOCA court today convicted three persons and acquitted four others in connection with the firing outside the residence of underworld don Dawood Ibrahim's brother Iqbal Kaskar here, in which the latter's bodyguard-cum-driver was killed.
"Although the court convicted Indralal Khatri, Bilal Mustafa and Rashid Sheikh, it acquitted four others including D K Rao, the trusted aide of fugitive underworld don Chhota Rajan," a police officer said.
Special Judge A L Pansare, other than acquitting four accused, also dropped the stringent MCOCA (Maharashtra Control of Organised Crime Act) from the case observing that there was no evidence to prove that the crime was an act of an organised crime syndicate.
The court is likely to pronounce the quantum of punishment next week.
The prosecution told the court that the attack was planned to prove the accused's supremacy in underworld.
The prosecution had examined 53 witnesses in the case, out of which four turned hostile.
In the firing incident that took place on Pakmodia Street in south Mumbai on May 17, 2011, Arif Sayed, the driver of Iqbal Kaskar, was killed. Kaskar was not present at the time of the firing.
Rajan has been shown as the wanted accused in the case.
