A court here today said it felt the atmosphere in a mahila court would be more congenial for transgenders to face trial in a criminal case filed against them.
Dismissing a petition by transgenders, seeking transfer of a criminal case to a special court from a mahila court, Principal Sessions Judge N Authinathan observed the petitioners and victim are transgenders. "By disposition and behaviour transgenders are more feminine than masculine. The atmosphere in a mahila court will be more congenial for them to face trial," he said.
The judge said the transgenders would fit in the company of women than of men. No prejudice would be caused to the transgenders. After all the case has to go on for an eventual disposal following the procedure contemplated under law. Prudence requires the case be disposed of by the mahila court, the judge said.
"I am not inclined to withdraw the case from the file of mahila court," judge added.
