Additional Sessions Judge Lokesh Kumar Sharma directed the Medical Superintendent to depute any officer to appear before the court with the medical records of Jagriti, who is seeking interim bail on health grounds, on the next date of hearing on October 21.
The order came after the authorities of Tihar jail, where Jagriti is kept under judicial custody, informed it that despite court order, All India Institute of Medical Sciences (AIIMS) officials were not forwarding the medical reports of the accused to them.
"She (Jagriti) does not want to carry the stone further. She should be granted interim bail so that she could undergo surgery soon," Dubey said adding there might be complications in the surgery as Jagriti is having only one kidney.
However, the court observed if doctors at AIIMS have given a probable date in December then there might be no urgency for the surgery.
The jail authorities had earlier informed the court that Jagriti was taken to the AIIMS for a check-up.
The court had on October 14 asked Tihar Jail authorities to explain why medical records of Jagriti were not placed before it despite a specific direction.
Jagriti has, in her plea seeking interim bail, said that she needed to undergo surgery for her ailment due to her deteriorating health condition.
