Man disabled in road accident gets over Rs 12L compensation

A 58-year-old man, who got disabled in a road accident involving a rashly driven DTC bus, has been awarded a compensation of over Rs 12 lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed the United India Insurance Company, insurer of the DTC bus, to pay Rs 12,48,918 as compensation to Uttar Pradesh resident Jagaram, who was walking towards Khajoori Khas here last year when the rashly driven bus hit him.
"I award the compensation amount in favour of petitioner (Jagaram) and against the respondents (bus driver, DTC and insurance company) on account of their liability being joint and several," MACT Presiding Officer Sanjeev Kumar Singh said.
The tribunal, while awarding the compensation, relied on the documents submitted by Jagaram, including FIR, mechanical inspection report and his medical report.
"After considering all documents filed by petitioner as well as DAR filed by the police as a whole it is clear that the driver was driving the vehicle in rash and negligent manner," it said, while noting that he suffered 60 per cent disability in his left leg.
According to the petition filed by Jagaram, a labourer, on the afternoon of September 4, 2013, while he was walking from Timarpur to Khajoori Khas, a rashly driven DTC bus hit him near Wazirabad flyover.
Due to the impact, he fell down and sustained grievous injuries and suffered disability in left leg, it said. He claimed a compensation of Rs 25 lakh for the grave injuries he had received.
The driver and the depot manager of Delhi Transport Corporation (DTC) in Kingsway camp here, denied the accident through a written statement and claimed that the petition made false allegations.
The tribunal, however, relied on the testimony of Jagaram and the doctor, who revealed that he suffered disability.
