Man gets 40 months RI for causing death by negligence

A local court today convicted and sentenced a 30-year-old man from Bhayander in the district to 40-month rigorous imprisonment for causing death of a nine-year-old boy by negligence in 2011.
The court of additional sessions court judge V K Shewale held the accused Pintu Raute guilty under section 304-A of Indian Penal Code (IPC) and not under section 302 (punishment for murder) of IPC slapped by police.
The court also imposed a fine of Rs 15,000 on the convict and directed that the amount will be paid to the family of the deceased.
It was the prosecution's case that Raute suspecting that the boy, who stayed in his neighbourhood, had come to his residence with an intention of stealing a water can thrashed him. The incident took place on April 25, 2011 and the victim, identified as Ramesh Chabbaria, succumbed to his injuries on April 30.

Raute was arrested and subsequently booked under section 302 of IPC by police.
However, the court held that the incident happened on the spur-of-the-moment and the accused had no intention or knowledge that the boy would die due to thrashing.
The court examined as many as 13 witnesses, including mother of the victim and the neighbours.
