District and sessions judge Ravinder Kaur handed down the jail term to Delhi resident Nakul Dass for the offence of attempt to murder under section 307 of the IPC.
"Keeping in view that Dass is a first time offender and has small children to be taken care of, besides his old parents and wife, who are living in great difficulty, in the interest of justice, he is sentenced to rigorous imprisonment for one year," the judge said, while also imposing a fine of Rs 2,000 on him.
"The conduct of the accused (Dass) itself shows that he was desperate to talk to the injured (woman) who had been residing earlier with him as his wife for the last about one- and-a-half years but now for the past 10 days she had started residing with her previous husband," the court said.
"On account of this development that she started staying with her previous husband appeared to upset and enrage him (Dass). The testimony of the injured (woman) has not been rebutted or shattered by the defence counsel during lengthy cross examination," it noted.
According to police, the woman, who was previously married and has kids, moved in with Dass in March 2012 but a year-and- a-half later, she reunited with her husband Shankar.
The woman, who worked as a domestic help in Dwarka here, told police that 10 days after moving back to her husband, on the morning of September 6, 2013, she was on her way to work when Dass pulled her near a bus stop forcing her to talk to him.
When she refused, Dass injured her with a blade and when she fell down, he kicked her repeatedly.
Dass pleaded innocence and claimed that the woman had falsely implicated him at the instance of her husband.
He sought leniency from the court on the ground that he was the sole earning member in his family consisting of his four children, a wife and old parents who had to be taken care of.
