The division bench of Chief Justice P C Tatia and Justice Jaya Roy asked why the police had taken 24 hours to register the case and to reach the spot late.
The court's observation came after it found in the home department's report the long gap -- 24 hours -- between the time of occurrence and the police registering the case.
Taking suo motu cognisance yesterday following the January 14 crime at Jemuniatand village in Garhwa, the bench had yesterday served notices to the state and fixed hearing in the first week of February.
The home department submitted its report today.
Garhwa Superintendent of Police Michael Raj yesterday said the girl's uncle filed an FIR accusing one Tarif Ansari of crimes under IPC Sections 302 (murder) and 201 (causing disappearance of evidence of an offence committed).
The girl did not return home after she went to watch a local football match being played at a school ground and her body was recovered later.
