MMRDA sends notice to MCA over plot lease deed 'breach'

The MMRDA has issued a notice to the Mumbai Cricket Association (MCA) for allegedly violating terms and conditions for a plot of land allotted to it in the plush Bandra-Kurla Complex.
The Mumbai Metropolitan Region Development Authority (MMRDA) had allotted the plot measuring 52,157 sq meters to MCA in March 2004 on a lease of eighty years with an FSI of 1.5.
The property was meant for development of various sport facilities and education and the MCA was charged Rs 2.66 crore for the piece of land.
In response to an RTI query filed by activist Anil Galgali, the MMRDA said it has slapped a notice on the MCA for violating the terms and conditions after it found that the land was being used for commercial purpose.

The notice, which was issued recently by MMRDA Commissioner A R Wankhede, reads, "MCA, by entering into the concession agreement with Shirke Infrastructure without prior written consent of MMRDA, has violated terms and conditions, which clearly stipulates that MCA shall not sell, mortgage, assign, underlet or sublet or part with the possession of the demises property."
"However, MCA violated the terms and conditions agreed upon in the lease deed and we hereby call upon you to rectify the breaches within a period of three months to our full satisfaction, failing which, the lease deed shall stands terminated and we shall re-enter the said property without being liable for any cost."

When contacted, Wankhede said, "We had found irregularities in our audit that led us to look into the matter. Prima-facie we have found violation and have asked the MCA to rectify it or prove our inspection wrong."
Talking to PTI, Galgadi alleged, "The issue is not as simple as it appears. It is a scam worth over Rs 1,000 crore. I have demanded Chief Minister Devendra Fadnavis to get the issue investigated.
