Moushumi Chatterjee's son-in-law tells HC he won't stop her from seeing her daughter

The Bombay High Court Saturday disposed of a petition filed by actor Moushumi Chatterjee seeking she and her husband be appointed guardians of their comatose daughter Payal.

A bench of justices B P Dharmadhikari and Sarang Kotwal disposed of the plea after Payal's husband Dicky Sinha filed an affidavit, assuring that his family will not stop Chatterjee from meeting or tending to her daughter.

Chatterjee and her husband Jayanta Mukherjee moved the court earlier this week, requesting that they be appointed the guardians of their daughter and allowed to take care of her.

They alleged that while their daughter is in coma, Sinha was preventing them from even seeing her.

Payal suffers from juvenile diabetes, they said.

Payal, who married Dicky Sinha, a businessman, in 2010, was in and out of hospital since April 2017, and lately her health deteriorated and now she is in bed in a comatose condition, the petition said.

She was discharged on April 28, 2018 and put on "home care" with the doctors prescribing her physiotherapy, it said.

However, in the last few months, the physiotherapy treatment was discontinued, the petition alleged.

Sinha also refused to give Chatterjee copies of Payal's medical papers, and therefore she does not know her daughter's current health condition, the plea claimed.

The bench remarked that both the parties were "educated people" and it was unfortunate that such matters had to land in the court.

"We are disposing of the petition now since the affidavit (filed by Sinha) states that the parents will not be prevented from meeting their daughter. They must also be given copies of hospital records, medical reports, etc, by Monday," the judges said.
