The court of Special CBI Judge S Lal here had taken strong exception to the non-appearance of Kushwaha and senior IAS officer Pradeep Shukla in the multi-crore scam case.
The judge had asked the superintendent to explain how Kushwaha, who was lodged at the said facility, was allowed to be shifted to the Sanjay Gandhi Post Graduate Institute hospital in Lucknow.
In his response filed today, the superintendent said he had gone on two days' leave at the time when Kushwaha was shifted out of his jail. But all procedures had been followed in the matter, he maintained.
In case an inmate's condition was especially serious, permission had to be taken from the DIG of jails for moving him out, Lal had added.
He had also pointed out that even the court's permission was needed for such a step, adding that none of the above guidelines had been followed in moving Kushwaha out of Dasna jail.
