Petition challenging CBI probe into selections made by UPPSC dismissed by HC

The Allahabad High Court today dismissed a writ petition challenginga CBI inquiry into the selections made by the Uttar Pradesh Public Service Commission ( UPPSC ) between April 2012 and March 2017.
The petition was filed by the UPPSC through its chairman Anirudh Singh Yadav and members.
The Centre on the recommendation of the state government had passed an order for a CBI inquiry into the selections made by the UPPSC during the above-mentioned period.
A bench comprising Chief Justice DB Bhosale and Justice Suneet Kumar after hearing concerned parties had earlier reserved its judgement on the matter.
During a previous hearing, the court had asked the counsel for the state government to apprise it on what basis the state government had recommended a CBI probe in to the selections.
In the petition it was said that the UPPSC was a constitutional body and therefore a notification directing the CBI inquiry was illegal and without jurisdiction. As per the petition, no inquiry against the commission can be directed under existing laws.
Counsel for the state government had opposed the petition andsaid that in case of any allegations of irregularities in selections made, government can recommend a CBI inquiry.
The central government on the recommendation of the state government passed an order for a CBI inquiry in the selections made by the UPPSC between April 2012 and March 2017.
