The PIL, which is likely to come up for hearing later this week, has been filed by advocate Anoop Barnwal who has termed the selection process as "illegal", "unlawful" and in violation of UP Lokayukta Act.
The petitioner's contention is that according to Section 3 of the Act, Lokayukta has to be appointed in consultation with the Chief Justice of the Allahabad High Court as well as the Leader of the Opposition in the UP Vidhan Sabha.
The petitioner has alleged that while the Leader of the Opposition was taking part in the selection process, the CJ of the High Court has been kept out.
