A court here has directed the Delhi Police to lodge an FIR and probe the allegations of cheating, forgery and criminal conspiracy against some members of the Aam Aadmi Party (AAP) for purportedly filing a forged document with the Election Commission.
"Keeping in view the facts, circumstances of the case and documents adduced on record, this court is satisfied that prima facie cognizable offences are disclosed
"...And the investigation by the police is required to unearth the true facts and to ascertain the allegations of cheating, forgery and criminal conspiracy allegedly committed against the complainant," Metropolitan Magistrate Akash Jain said.
"The present application under section 156 (3) CrPC of the applicant is accordingly allowed. SHO PS Parliament Street is directed to register FIR in the present case under appropriate sections of law and proceed with the investigation," the court said and fixed the matter for further proceedings on August 20.
The order came on a petition filed by the founding member of a political party seeking registration of an FIR alleging that AAP had "sent a forged resolution" of his party which was purportedly signed by the accused who were earlier associated with his party.
The complainant alleged that these accused had forged the documents in pursuance of criminal conspiracy with each other.
He further alleged that he had filed a complaint in this regard but no action was taken on it by the police.
The court, after hearing the arguments, directed the police to lodge an FIR under appropriate sections and probe the matter to ascertain the truth.
