The direction was issued by a division bench comprising justices Antony Dominique and D Sheshadri Naidu while upholding the order of the Kerala Administrative Tribunal.
During 2007, PSC had invited applications to the post of Sub-Inspector and preliminary examination was conducted for which 49 per cent was fixed as cut off mark. None of the candidates in the reserved category secured the cut off mark.
Hence, candidates who secured lesser than the cut off mark were permitted to participate in the selection process.
This was challenged by a batch of candidates in the general category before the KAT, which found that persons included in the general category lost their opportunity and directed that the rank list be re-cast and the list of reserved candidates be published separately, which was upheld by the high court.
