When the matter came up for hearing, Justice D Hariparanthaman ordered issuing of notice to Puducherry Chief Secretary.
P Saravanan from Puducherry, in his quo warranto petition, challenged the continuation of R Anbalagan as Secretary of the Assembly and sought to know under what authority, the incumbent officer continued to work.
He submitted that Anbalagan was working as Deputy Commissioner of Central Excise for nearly 10 years and he was appointed to his present post on July 5, 2012, with additional charge.
Under the rules, no extension shall be granted beyond the age of 60 except in special circumstances. No such special circumstance was mentioned in the appointment order of Anbalagan, he contended.
