Rape accused moves HC for quashing FIR

The Delhi High Court today sought response from police on a plea for quashing of the FIR lodged against a tourist taxi operator accused of having raped a woman in his car in March this year.
The high court, however, did not go into the remaining aspect of the accused's plea in which he has volunteered to undergo narco analysis, brain mapping or polygraph test on him at his cost to prove his claim that he is innocent as well as seeking damages of Rs five crore for being allegedly falsely implicated in the case.
Justice Sunita Gupta sought a status report from Delhi police and listed the matter for hearing on April 24.
Accused Jojo Mathew, in his petition filed through advocate Wills Mathews has also sought a CBI probe into the circumstances leading to the registration of FIR under section 376 (rape) against him and his subsequent arrest.
The accused has alleged that the complaint of rape was lodged by the woman against him in retaliation for the legal notice sent to her to not harass him.
Jojo Mathew, who is out on bail after spending over two months in custody, has volunteered to undergo all the tests saying he needs to prove his innocence as his arrest and subsequent media coverage of the same has ruined his and his family's reputation.
