The court's order came on a revision petition of the woman, a senior officer of the institute based in south Delhi's Vasant Kunj area, whose complaint against the CMD of the college was dismissed by a trial court in 2012.
Additional Sessions Judge Manoj Jain, while upholding the trial court's order, said, "Nothing has been explained as to why there was so much unexplained delay in filing the complaint to the police authorities. There is nothing on record to show as to why the complainant did not file her compliant at earliest possible opportunity."
The sessions court also said there was no medical evidence to prove that she was raped.
"There is nothing on record to show that she had taken the remedial measures...There is no medical evidence on the record file to support her version to the effect that she was raped and molested by the accused as alleged," it said.
She had further alleged that she was given promotions and whenever she decided to quit the job, the CMD apologised to her in the fear of a police complaint. However, she finally left the job and lodged a complaint against him in January 2009, it said.
The plea claimed that she had also approached the Delhi Commission for Women in December 2008 and, then police, but no action was taken, hence, left with no other remedy, she filed this complaint.
