Road accident: Bizman's family gets Rs 18 lakh compensation

The kin of a businessman, who died in a road mishap involving a rashly and negligently driven car, have been awarded a compensation of nearly Rs 18 lakh by a Motor Accident Claims Tribunal (MACT) here.
The Tribunal directed Bajaj Allianz General Insurance Company, with which the car was insured, to pay Rs 17,81,533 to the wife and son of victim Chandra Prakash Arora who died in the accident in 2008.
MACT Presiding officer Rajendra Kumar Shastri said when a speeding car hits a scooter going on left side of road from behind showed in itself the rash and negligent driving by the car driver.
"Medical record of the victim put on file verifies injuries having been suffered by deceased Chandra Prakash. Considering all this, I have no hesitation in coming to conclusion that the accident in question was caused due to rash and negligent driving of respondent no. 1 (car driver)," the presiding officer said.
Arora's wife and son said in the petition that the accident had taken place on March 30, 2008 when the 46-year-old victim was riding his scooter in north west Delhi at a slow speed.
When he reached near Sector 16-17 in Rohini, the car came at a high speed and hit Arora from behind. One Gurmeet Singh was driving the car.
Arora fell down and suffered multiple injuries and was taken to hospital. While he was under treatment, he died one month after the accident on May 1, 2008.
Car driver Singh and owner Jaswinder Kaur claimed in the Tribunal that the accident was caused due to negligence of the victim.
The insurance company also claimed that it was not liable to pay any compensation as the car owner had not informed it about the accident.
According to Arora's family, he was running a bakery shop and was earning Rs 15,000 per month.
