Rs 17.5 lakh compensation for family of road accident victim

Family members of a 48-year-old woman, who died after being hit by a rashly driven motorcycle, have been awarded a compensation of over Rs 17.5 lakh by a Motor Accident Claims Tribunal (MACT) here.
The incident took place on March 18, 2014 around 11.30 PM.
MACT Presiding Officer Sanjeev Kumar Singh directed Oriental Insurance Company Ltd, insurer of the offending bike, to pay Rs 17,59,890 to the husband and daughter of Suwari Devi, who was hit by the mobike while crossing a road in Civil Lines area last year and was grievously injured and later succumbed to death.
The tribunal, while holding the mobike rider guilty of rash driving, relied on the mechanical inspection report of the vehicle.

"...Reading all the documents, specifically the mechanical inspection of the offending motorcycle depicting damages, head light and speedo meter broken and scratches on it, filed by the petitioners as a whole it is clear that the bike was being driven in a rash and negligent manner," it said.
The tribunal also relied on the FIR filed against the accused and the post mortem report of the victim while awarding the compensation her husband Bhagat Singh, a resident of Timarpur in north Delhi.
In his petition, Bhagat claimed a compensation of Rs 30 lakh for the untimely death of his wife who was a homemaker.

During the proceedings, the accused rider, owner of the two-wheeler and the insurance company denied the contents of the petition that the motorcycle was rashly and negligently driven.
