The Meghalaya High Court today issued notices to West Garo Hills district Superintendent of Police Mukesh Singh in a contempt petition filed by a woman who was arrested two months ago.
Nitu N Marak filed a contempt petition against the district police chief for allegedly violating the Supreme Court judgement in D K Basu versus West Bengal government in 1992, in not following guidelines while arresting a person.
Admitting the petition, Chief Justice P C Pant, gave the district police chief and two senior lady police officers P Chettri and C P Marak four weeks time to reply.
"The Chief Justice passed an order by issuing notices to all the respondents including the SP, the IO and the Officer In-charge of Tura Women's cell, to show cause and file an affidavit in response to the allegation by Marak," the petitioner's counsel Sujit Dey told PTI.
The petitioner alleged she was picked up by the two police officers on May 12 on the instruction of the SP and that she was forced to confess that she was responsible for sending two persons, L Balsan and Chekan, to kidnap a woman.
Balsan later died in judicial custody after alleged police torture.
The woman, breastfeeding her two month-old baby, was sent to judicial custody by a local court and later released on bail.
Marak also alleged certified copies of all documents from the court were received only after two months after which she could move a contempt petition against the policemen.
