the forcible dispossession of farmhouse No 42, DLF farms by Ponty, Namdhari and their men was well thought conspiracy hatched by them. "There was a a long standing property dispute between brothers Hardeep and Ponty. It has emerged that since the last one year, after the death of their father, the dispute between brothers had escalated, necessitating the intervention of Hardeep's father-in-law on few occasions, the latest being on November 16, a day before this incident. "Hardeep and Ponty, both real brothers were not even on talking terms with each other," the charge sheet said. The court took cognizance of the charge sheet and directed the Police to produce Namdhari and the 10 other arrested accused before it on February 19. Ponty and Hardeep, who had an alleged property dispute, were killed in a shootout at a Chhattarpur farmhouse on November 17, last year. The charge sheet has also listed 109 prosecution witnesses. A copy of the charge sheet was provided to all the parties in the case. Out of 22, police had arrested Namdhari, Tyagi and nine others for their alleged role in the case. Against eight the court has issued proclamation under CrPC. However, as Ponty was killed during the commission of offence, therefore the charge sheet against Ponty may be "abated". "The death of Hardeep caused by Namdhari and Sachin as result of their common intention was foreseeable and probable even during the execution of the criminal conspiracy. "The kind of arms and ammunition utilized by the accused and the forcible dispossession of farm house shows that they had decided to remove any obstacle to the success of the plan, even if it meant killing any person," the charge sheet said.
