Delhi Waqf Board has moved the Delhi High Court challenging the AAP government's decision of transferring its powers and duties to the revenue department of the city administration for six months.
Justice Rajiv Sahai Endlaw, before whom the matter was listed, adjourned it to November 5 to be taken up with another plea moved by the Board for directors to the Delhi government to notify that its Chairperson has been elected.
The court decided to hear both the matters together after lawyers appearing for the Board sought a passover as their main counsel had not arrived.
DWB has challenged the October 8 notification by which the Delhi government has with immediate effect "superseded" the Board for a period of six months.
The notification has also stipulated that "in accordance with Section 99(2)(b) of the Waqf Act, 1995, all the powers and duties of the Board under the provisions of the Act will be exercised and performed by the Secretary (Revenue) Government of NCT of Delhi".
