Youth acquitted of kidnapping, raping girlfriend

A youth accused of raping his girlfriend on the pretext of marriage has been acquitted by a Delhi court which said whatever happened between them was with the girl's consent.
Additional Sessions Judge Yogesh Khanna absolved Delhi resident of the charges of raping and abducting the girl, who had also become pregnant, after the girl wished not to pursue the case, and informed the court that she had married to the accused and is living happily.
"Considering the facts and circumstances of the case, wherein the prosecutrix (girl) had turned hostile and had not supported the case of the prosecution and had rather denied the contents of her complaint and statement, the accused (boy) becomes entitle to benefit of doubt...The accused is entitled to be acquitted of the charges framed against him," the court said.
According to prosecution, the girl, pursuing her computer course here, was raped by the boy several times since February 2007.
In her complaint, she had alleged that after the accused became her friend, he used to establish physical relation on the pretext that he loves her and will marry her.
"The girl, who became pregnant, was also forced to abort her baby on several occasions," the police had told the court.
In September 2013, the girl came to know that the boy was already married, it added.
However, the court during the trial noted that, "Nothing wrong was done by accused to the girl and whatever happened with her was with her consent and she made physical relations as she agreed to marry."
The girl also during her deposition said that "I had made the present complaint out of anger and misunderstanding as accused was delaying marriage with me".
