Delhi HC lashes out at man owning four cars and seeking parking in housing society

The Delhi high court has come down heavily on residents who own many cars and demand the right to park them within the premises of the housing society that they stay in.

Disposing of a plea by a Delhi resident who owns four cars and had complained against the housing society for charging him extra for parking his vehicles, the court noted that buying vehicles should be “guided by need, not greed.”

A flat owner can park just one vehicle in the designated parking lot allotted by the housing society, said the court. “Air pollution is not the only environmental impact that vehicles cause,” said the court. “Parking of excess cars in open areas reduces available space underneath them for rainwater harvesting, which enables charging of aquifers - another adverse impact on environment.”

It pointed out that common areas in a housing society are meant for all members and no one has the right to appropriate the same for personal use.  “Even transient parking of any open areas beyond the basement is certainly encroachment, albeit temporary, and cannot be treated as anything else,” said the court, which also imposed a cost of Rs1 lakh on the petitioner.
