The Bombay High Court today allowed Reliance Industries (RIL) to amend its plea in its suit against National Thermal Power Corporation (NTPC).

Single judge of the high court had earlier allowed RIL to amend its plea but NTPC filed an appeal against the decision before a division bench, which dismissed the plea by the government-run power company.

The division bench of Chief Justice Swatanter Kumar and Justice A M Khanwilkar also directed that RIL will bear the cost of Rs 25,000 for seeking the amendment.

NTPC lawyer D Madon sought a stay on today's order to enable it to file an appeal in the Supreme Court, but RIL counsel Milind Sathe assured that RIL will not carry out the amendment for four weeks.

Mukesh Ambani-led RIL through the proposed amendment would be able to bring on record the central government's affidavit filed in Jaunary this year in the RIL-RNRL gas dispute case in the high court.

In that affidavit, the Centre had said that as per decisions of the Empowered Group of Ministers, the government, not RIL, will decide who would get gas from KG basin.
