In order to gain her kids' custody, Kelly Rutherford filed a federal lawsuit to challenge the verdict of a Manhattan judge but her suit was denied the same day.
The 46-year-old actress, who was ordered to produce her children Hermes and Helena in to court so that they could leave to return to their father in Monaco, challenged the court's ruling by saying that the decision was incorrect, reported Us magazine.
The 'Gossip Girl' star and her former husband Daniel Giersch, who split in 2008 when Rutherford was pregnant with Helena, have been fighting for custody of their children since their divorce.
