The Supreme Court has referred the petition of the Aam Aadmi Party (AAP) seeking the dissolution of the Delhi assembly and conducting fresh polls, to a Constitution Bench.

The AAP had moved the top court to direct the central government and the lieutenant governor to dissolve the Delhi assembly and order fresh elections.

Bharatiya Janata Party's (BJP) counsel Aman Sinha, said a five-member bench would hear the petition on August 5.

"The Supreme Court heard our objections on a preliminary basis. After hearing us, they said that all questions with regard to maintainability of the writ petition and all our objections-they remain open. And the matter has been referred to a Constitutional Bench to hear all the objections on them - maintainability of the writ petition and the whole writ petition in its entirety on 5th of August," said Sinha.

AAP leader Manish Sisodia claimed that the BJP and the Congress Party had joined hands to delay the polls in Delhi.

"Congress and BJP both claim that they are ready for polls. But in court today, lawyers of both the parties said the assembly shouldn't be dissolved and elections shouldn't be held. Why is the BJP scared of polls? They are in government. Immediately they should hold. Why are they scared? I think their good days are over," said Sisodia.
