Compensate victim of attempted rape: NHRC to Delhi government

The National Human Rights Commission (NHRC) has asked the Delhi government to pay Rs.3 lakh as compensation to a victim of attempted rape, according to an official statement Wednesday.

A 13-year-old girl along with two other minor girls were allegedly abducted from west Delhi's Vikaspuri area by two policemen in October, 2013.

The policemen took the girls to Police Colony in Kingsway Camp in north Delhi. They then tried to rape one of the girls.

"The commission while passing the recommendations set aside the contention of Delhi Police that the constables had committed the crime in their personal capacity and the commission may take a lenient view," said the statement.

However, the NHRC has observed that the accused were posted in the third battalion of Delhi Armed Police as constables and were dismissed for the offence which took place at their official accommodation.

"Thus, it cannot be said that the accused police officials had lost official capacity of a government servant at the time of committing the offence of violating the human rights of the victims for which the state must bear the liability," it added.

The chief secretary of the Delhi government has been asked to send a compliance report along with proof of payment within six weeks, the NHRC said.
