The Himachal Pradesh High Court Friday quashed the state law on pay, allowances and service conditions of subordinate courts' employees and directed the state to implement the Justice Shetty commission recommendations from April 2003.
The judgment was delivered by a division bench of Justice D.D. Sud and Justice D.C. Chaudhary on a petition filed by the HP Non-gazetted Judicial Employees Welfare Association challenging the validity of the 2005 act.
"The act is a colourable exercise of legislation as it overrules the directions of the Supreme Court to implement the Shetty commission recommendations uniformly throughout the country," the court observed.
