SC junks plea against two BJP MPs in Prajapati case

The Supreme Court Tuesday refused to hear a plea against BJP lawmakers - Rajya Sabha members Prakash Javdekar and Bhupendra Singh Yadav - for their alleged attempts to derail the trial in the Tulsiram Prajapati staged shootout case.

"What is your locus? You have no locus," said a bench of Justice B.S. Chauhan and Justice S.A. Bobde while rejecting the plea by journalist Pushp Kumar Sharma who had carried out a sting operation which alleged that the two were involved in derailing the course of justice.

The court was unmoved as counsel Kamini Jaiswal, appearing for Sharma, submitted that "it is a subversion of the process of law" and sought to draw the attention of the court to the plea.

"If Narmada Bai (mother of Prajapati) was aggrieved then let her come to us," the court said declining to entertain the plea.

The court, however, while allowing the plea to be withdrawn, said that petitioner may move before the trial court or file a petition before the high court.

The petitioner had alleged that the BJP lawmakers were trying to subvert the course of justice in order to save Gujarat's former minister of state for home Amit Shah who is the main accused in the case.

Tulsiram Prajapati was killed in a staged shoot out Dec 28, 2006.

Shah, a close aide of BJP's prime ministerial candidate Narendra Modi, also happens to be an accused in the Sohrabuddin Sheikh staged shoot out and Kausar Bi elimination case.
