Ram Janmabhoomi-Babri Masjid dispute

The Supreme Court on January 4 will start hearing a batch of petitions on deciding the land title dispute in the Ram Janmabhoomi- Babri Masjid case. On that day, the court is likely to fix a date and decide on the appropriate Bench that will hear the petitions.

Challenges to IBC 

A batch of petitions by operational creditors (OCs) has, among others, challenged the validity of various sections of the Insolvency and Bankruptcy Code, such as Section 7, Section 9, and Section 29 (A). With the Supreme Court observing the operational creditors should get their due, it will be interesting to see the outcome of the case. The court has asked for the government’s view on the demands of OCs.

Fight against RBI circular 

Power, sugar and shipping companies have moved the Supreme Court challenging the Reserve Bank of India’s (RBI) February 12 circular which asked banks to move insolvency cases against lenders who had defaulted on their loans. Some power and sugar firms had earlier moved the Allahabad High Court, which rejected the challenge to the circular. Other companies had similarly moved other high courts across the country.

RCom-Jio spectrum sale

Reliance Communications’ spectrum and asset sale deal to Reliance Jio Infocomm has hit multiple roadblocks, including the latest where the telcom department refused to give its No Objection Certificate for the sale. Reliance Jio Infocomm has made it clear it won’t be responsible for any previous liabilities of RCom. And now, the latter is facing an insolvency threat from Ericsson India. RCom failed to pay Rs 5.5 billion to Ericsson by the December 15 deadline.

Daiichi vs Singh brothers 

The Fortis Healthcare case, involving Daiichi’s enforcement of its Rs  35-billion award against Malvinder Mohan Singh and Shivinder Mohan Singh, former promoters of the health care firm, has branched into multiple litigations in several courts and fora. While the Delhi High court is hearing the case of enforcement of the award, the Supreme Court had in a hearing stayed the sale of Fortis Healthcare to IHH Berhard.
