The Maharashtra ATS, which had initially probed the September 2008 Malegaon blast case, today failed to produce any video or audio evidence in the Bombay High Court to back its claim that prime accused Sadhvi Pragya Singh Thakur was present in the meeting at Bhopal where the blast conspiracy was hatched.
A division bench of justices R V More and Shalini Joshi had last month directed the trial court to release three packets containing audio CDs and DVDs submitted by the ATS along with its supplementary charge sheet.
The high court had sought the audios after NIA, probing the case, said it was not aware of any recording of the Bhopal meeting.
The bench is hearing an appeal filed by the Sadhvi challenging the trial court order rejecting her bail plea.
The court today heard the audio CDs in its chamber. The court later said none of the CDs have any relevance to the present bail appeal filed by Sadhvi.
The ATS told the court it could not identify the CD/DVD containing the Bhopal meeting video and that it wasn't even sure if it had such a recording.
The high court is likely to resume the hearing in the case on February 16.
