It also asked whether the Rs 7.5 lakh compensation was paid to the family of the deceased and directed the government to submit the information by January 31, 2015.
Surendra Kumar Rajak, son of SI Krishna Baitha posted at Baniapur police station in Saran district of Bihar, had complained to the Commission that his father was shot by another SI Ajay Kumar Singh Yadav posted at the same police station over sitting arrangements in a police SUV on August 29, 2013, said BHRC member Neelmani.
"The bullet pierced the abdomen of Baitha. He was rushed to Patna Medical College and Hospital, where he died on September 1, 2013," Neelmani said.
The BHRC member said the FIR was registered with delay and the accused SI was not arrested. The response from the DIG of that area mentioned that definite conclusion could not be arrived regarding his guilt.
"Finding undue delay in investigation of such an important case, we directed the DIG to appear before us with definite decision in the case and status of investigation.
The DIG also informed that the accused SI was absconding after suspension and property attachment order against him has been obtained from the court on July 6, 2014.
"Finding such inordinate delay in investigation and execution of court order, we have sought a report from the state government. We don't want the guilty to remain free and the victim's kin to suffer any further. We will take further action once we hear from the state government," Neelmani added.
