The case came up for hearing before the Ahmedabad bench of judicial members M Nagarajan and K Kailashnathan and February 24 was set as the next date of hearing.
The Gujarat government had filed its charge sheet against him for delaying in depositing his service revolver after he was transferred from Gandhinagar, where he was serving as a Superintendent of Police, to Junagadh as the Vice Principal of the Police Training College in 1999.
In his application before the CAT, the 1988 batch officer said that he continued to use the same revolver till 2003 until he received a new revolver, as an IPS officer was entitled to keep at least one service revolver at a time for his personal security.
He also contended that the charge sheet was against the provisions of the All India Services Rules that requires that a charge sheet against an IPS officer should be approved by the Chief Minister, but, in his case it was directly filed by the Additional Chief Secretary of the Home Department.
A charge sheet was filed against him for allegedly beating up a wrong accused in a lock up in connection with the kidnapping of a seven-year-old girl when he was serving as SP, Gandhinagar in 1999.
He approached the CAT New Delhi against the dismissal
Among other charges against him are filing FIR against a Police Sub Inspector and a Deputy Inspector General (DIG) of Police at Adalaj police station in Gandhinagar while serving as Gandhinagar SP.
He was also charged with supervisory failure for allegedly not ensure that a Deputy SP-rank officer conduct investigation in a SC/ST case.
