Consumer Forum asks auto dealer to pay Rs 2 lakh compensation

An automobile dealer here has been ordered by the District Consumer Redressal Forum to pay a compensation of Rs two lakhs to a car buyer for deficiency in service and the resultant loss suffered by him.
In its recent order, Forum President Umesh Jhawalikar and member N D Kadam, held that the Tavera car dealer has defaulted in service on account of registration of the vehicle purchased from it.
The case relates to the complaint made by one Jebestin J Nadar who purchased a Tavera car in 2011. According to him, the dealer had not provided him with the registration certificate with the RTO due to which he could not not make use of the car.
In his complaint, he told the Forum that he had purchased the car from the dealer and had made an initial payment of Rs 2,25,000 on March 7, 2011 and again made a payment of Rs 6,00,000 on March 24, 2011 by taking a loan from Syndicate Bank.
It was agreed that after the payment of the full amount the car would be delivered within 21 days as per the proforma invoice dated March 7, 2011.
However, he said the car was delivered only after three months on June 30, 2011 despite the fact that the money was paid in full on March 24, 2011.
He also said that as the dealer did not provide him with the RTO registration on the stipulated time, he could not make use of the car and hence claimed compensation from them.
He lodged a claim of 21 percent interest on the amount already paid and a compensation of Rs 4.99 lakhs towards his sufferings and to get the vehicle registration done from RTO.
Countering the submissions by the complainant, the respondents told the Forum that the former had failed to make the payment of Rs 67,057 towards increased cost as well as the cost of spare parts fitted to the vehicle due to which it could not be registered.
