Khushwaha surrendered before the investigation officer at the police headquarters (PHQ) in the evening, and was arrested after preliminary interrogation under sections 302 and 120 B of IPC for alleged murder, Additional SP of CID-CB, Sarita Singh told PTI.
The BSP MLA would be produced before a local court in Dholpur tomorrow, Singh said, adding the Rajasthan Legislative Assembly Speaker was informed of his arrest.
One accused Satyendra Singh was arrested earlier in this case while involvement of another two persons Shivram and Jeetu was also figured out along with Kushwaha, she said, adding the remaining two would also be arrested.
"Neither my name figured in the FIR related to alleged murder of one Naresh, resident of Jheel ka Pura under Dhimari Police station in Dholpur on Dec. 27, 2012 nor I am trying to abscond. FIR carries no name as an accused. In last two years I appeared before the IGP Bharatpur range for every query and recording of statement. Recently my anticipatory bail was rejected by the High Court, hence I will surrender", Kushwaha said in his address.
A single bench of Justice K S Aluwali had rejected his bail plea on the ground that he was "charged with a heinous crime" following which he could not be granted anticipatory bail.
Since the case is related to an elected representative, the state CID-Crime Branch is investigating it.
The Dholpur MLA, however has alleged that his implication in the case, is conspiracy of the BJP, but the rival party has rejected the charge.
"This is BJP's conspiracy to stop rise of BSP MLAs which are three in numbers in the Rajasthan House", he alleged.
BJP has "nothing to do with this case nor with the MLA Kushwaha's personal matters", Parnami said, claiming the action by police was taken based on facts and merits.
"I am going with my supporters to surrender before the Additional SP Sarita Singh in the police headquarters so that they can make any query. I know they can arrest me also for which I am ready", " Kushwaha earlier said at the rally.
