A Division Bench comprising Justice Sushil Harkauli and Justice Naheed Ara Moonis passed the order on the Public Interest Litigation filed by Federation of Noida Residents' Welfare Association (FONRWA), Gautam Buddh Nagar.

In the PIL, FONRWA claimed that the cost of building the 9.2 km-long DND flyway had been recovered and therefore the purpose of collecting the toll tax was over.

The petition stated the Noida Toll Bridge Company Ltd had not discontinued collection of toll tax from those who were using the eight-lane expressway.

Significantly, a recent hike in the toll tax on DND was met with much resentment from residents of Noida, following which the NTBCL had to order a rollback of the hike.

Toll charges were increased from Rs 22 to Rs 25 on November 9, and rolled back on November 18 midnight.

The court asked the government to file its reply within four weeks.
