Setting aside the order of a Single Judge, the Division Bench comprising Justice N Paul Vasanthakumar and Justice M Sathyanarayanan said, "The personnel to be selected to the police force should possess good qualities, particularly not to be involved in any criminal case."
The matter pertains to one Namasivayam who joined CRPF as constable on February 15, 2003. He was posted at Megalaya. On May 12, 2005, his name was struck off the rolls after issuance of statutory notice to him.
Due to his alleged involvement in a criminal case, he was terminated from the service.
Namasivayam then moved the Madras High Court and a Single Judge quashed the termination order.
Challenging this order, the department filed an appeal in which the Division Bench confirmed the termination order.
