In an interim order on a petition from the sailor's wife, a division bench comprising Justice V K Mohanan and Justice K Harilal said in view of the report furnished by NIMHANS "We are satisfied that Sahu has no psychiatric problems."
The bench directed Naval authorities to restore his leave from today for 26 days. After his leave, Sahu should report for duty at INS Kattabomman, at Tirunelveli, which comes under the Eastern Naval Command.
Considering the facts and circumstances of the case, the court reserved orders on the habeas corpus petition filed by his wife, who had alleged efforts were being made to establish that her husband was suffering from mental illness.
The Bengaluru-based National Institute of Mental Health and Neuro Sciences (NIMHANS) had in its report stated that Sahu was not suffering from any psychiatric problem.
The medical board stated 'no evidence of any current psychiatric illness could be determined on Sahu' and deemed him fit to be discharged.
Sahu's wife filed the petition in the court following which he was produced in court and first sent to Government medical College at Kalamassery and then to NIMHANS.
